Ladder trucks often far way: Public records can bring important public safety issues to light. A computer-assisted analysis of property records, ladder-truck locations and insurance-industry standards by Jeff Schweers of Florida Today revealed that in Brevard County “more than one-fourth of the 378 buildings four stories or taller are beyond the recommended range of a ladder truck.” Condominiums in the more residential neighborhoods in the county’s South Beaches are either outside the safety radius set by the fire protection industry or in cities with ladder trucks that can’t reach higher floors, the story said. More concerning, however, is that county and its cities are allowing tower projects without determining whether their fire departments can protect them.
Campaign bundles skirt law: Public records can show how the law doesn’t always work as intended. Campaign finance and corporate records analyzed by William March and Doug Stanley of The Tampa Tribune detail how corporate campaign giving is being manipulated to overcome state laws limiting the amount of contributions. Contributors are creating a laundry list of companies and then having them give the maximum $500 to selected candidates, which allows them to sidestep the ceiling on giving. For example, the story says, 15 companies headed by Kenneth L. Underwood of Ponte Vedra Beach gave $500 each on to gubernatorial candidate Charlie Crist on March 31 – just two days after the companies were created. But the story also identifies other instances where this appears to have happened and how much each of the four governor candidates have received in such contributions. Broward court cases hidden from the public: What’s not within the public record that should be can be very alarming. A review of court records by Patrick Danner and Dan Christensen of the Miami Herald helped determine that more than 100 lawsuits are being hidden from the public view on a secret docket in Broward Circuit Court. “Divorce, negligence, malpractice and fraud cases have all vanished into a kind of legal black hole where it’s impossible to tell not just what’s in them, but that they exist at all,” the story says. The practice flies in the face of two cornerstones of the criminal justice system: “that the courts must be open to public eyes, and that they must provide equal treatment to all.” The missing Broward cases include the divorce of a local TV news personality Martha Sugalski and lawsuits from the families of 17 autistic youths molested at their school. As a result of the Herald’s inquiries, Broward judges are studying the practice, which has also happened in at least Pinellas and Palm Beach counties. The public records handbook covers civil court lawsuits on Page 82.
Boot camp inspections missed red flag: Public records are revealing but can be fallible. Carol Marbin Miller of the Miami Herald reports that Florida boot camp inspections for years missed red flags from rising incidents involving the use of force. A Herald review of audits by the Department of Juvenile Justice depicted the Bay County Sheriff’s Office Boot Camp as a top operation. That was before the beating of 14-year-old Martin Lee Anderson by guards was caught on videotape. Anderson later died. The Herald found “that inspectors for years failed to detect that guards were routinely violating state policies that banned use of force – takedowns, chokeholds, pressure-point restraints – except as a last resort. As oversight broke down, physical force incidents escalated, the story says. The story includes several excerpts from past audits.
